Can you be fined for parking on private land that does not charge for parking?

I had a ticket for parking on yellow lines in a shopping centre car park.
£60 :mad: :mad:

I have a blue badge and timer thingy and it was all set to correct time and all above board.

How do I stand?

I have appealed obviously. smile.gif

Dave, The same happened to my mother a while back, she appealed and was told she was booked because she was causing an obstruction......and, I once saw a chap in a wheel chair, in tears while they towed his car away from the front of a Fire station.....

How can the 'fine' me on private land in the first place??????????

Nothing to say I couldn't park where I was, I was just following the highway code as for Blue Badge owners. sad.gif

I'll see what they say on the appeal.

But I will NOT pay a penny.

I'd rather go to prison.

Does the time of day have a bearing on this? I seem to remember reading, on the package supplied with the blue badge, that you/we can only park on yellow lines at certain times. I may be totaly wrong of course :confused: :confused:

12:13 on a Sunday.

I have checked my blue badge book and limited or restricted parking on yellow lines are backed by yellow markings on the kerbs.

Where I parked had none so therefore not causing an obstruction. smile.gif

Dave, Sounds like you have the same types as Edinburgh ...as in the Blue Meanies.. :mad: ..I used to deliver all round the centre of Edinburgh, and trust me, the Traffic Wardens are missed....at least they had a heart..... sad.gif ...and would come and go with you, if you were trying to do a delivery....I found that all over Scotland BTW...

norrie scots law is totaly differant to english
up here we dont have the time card associated with the blue badge in england they have time limits where as in general we dont.


phone the number on the ticket and explain the situation to them, ask why you were givin a ticket, wich law did you allegedly infringed they may overturn the decision ,dose the car park have disabled bays ,were they full, there should be a sign near to the entrance telling you what time limits apply. good luck

ps if that don't work involve the local press they might do a bit in the local paper about it or they may contact the centre ,wich in turn may drop the fine..

The main car park was full.
I parked on the road as near to the shop I wanted to visit.
It is a private firm called Enabled Parking Ltd and work out of a PO BOX number in York.

I asked the issuing attendant where the head office was and he said it was the PO BOX??????????

I searched Company House and found their office is in Yardley B'ham????????

Written to BOTH addresses and await their excuses. smile.gif

Not sure about Scottish law but most car parks are private land or at least not public highways and councils can charge to park by legal regulations. Private roads may have yellow lines but are not enforcable by law I doubt private companies can do that, which is why they employ clampers which now have to be licenced.

Why not try your local Council and see what status the road and markings has?

Thery do NOT have a leg to stand on Dave!! If they use Yellow lines then they have to abide by the law that governs them. Also what about the new law which came into force just the other day about clampers and private parking??
Basically the Blue Badge scheme works on both PRIVATE and public car parks/parking spaces. And unless there are signs displayed which SPECIFICALLY prohibit you from parking. You are NOT allowed to use road markings which are "Similar" to ordinary road markings unless teh markings are used in a manner becoming. IF you ARE causing an obstruction then they can take action but only then!! And then only in strict accordance with the law!!
Dave for what it's worth wait while they take you to court and make sure you have pictures and a "Witness!!"
