My partners daughter has just purchased a new house and the moved in just a couple of weeks ago. Since she moved in she had a visit from a chap who was trying to get a petition up against a proposed recyling plant to be build just a hundred yards away from where she lives. Apparently the county council knew about it before she bought the house. Does anybody have any idea what course of action should she start on? Should this info have been picked up by her solicitor on local searches?
It will obviously devalue the price of the house (160k) and if she wanted to move because of it make it very hard to sell.
All comments welcome.

Her Solicitor should most certainly have picked that up, on the Local Search.
I suggest she asks them for their comments.

Check out the plans though, I know of a recycling plant that is nothing more than a warehouse type building.
The vehicles that go there, enter the building to unload.
Those that take away the reclaimed stuff, are loaded inside the buildings.
The surrounding area is landscaped with lawns trees etc., and it looks OK.

If a full survey was made before she bought the house and nothing was mentioned then I would say she has a good case against the company that did the searches.

According to the guy who wants to get the petition up there will be something like 80 lorries a day going to and then leaving the plant each day. They will be carring industrial,roadside and general waste. These will come down an existing local road which is going to be altered to accommodate large vehicles but will be inaccessible from the house but very close maybe 50 yards from the end of their garden.

I do not know exactly when the proposal was put forward but I think that it was during the conveyancing period. It took the about six months to buy the house due to the chain breaking down and that sort of stuff, but it was definitely proposed before she actually bought it. I do not know however what the situation when they first contacted their solicitor.

One would have thought so, but as a director of a company that builds and sells houses, I am often amazed at how little some (not all, I hasten to add) solicitors do on their clients' behalf.

Have just sold a house where no "enqiries before contract" nor "requisitions on title" were asked for by the buyer's solicitors. One wonders if they did any searches either.

They even sent us the deposit with no questions asked before the house was built! (The buyer moved into the completed house last week)

We have just found out that another house we sold four years ago is still registered to us - the buyer's solicitor has not yet bothered to re-register it.

Its a good job we are above board......

Whenever I've moved house, I've ended up having to do the solictor's job and the Estate Agent's for them.

The quicker conveyancing becomes a software package, the better.
