The judge offers an opinion of what he thinks is likely the truth. For a criminal charge to stick, you have to prove beyond reasonable doubt that the defendant committed the crime. For a civil case, you only have to prove that they probably did what you are accusing them of.

You don't think the "reasonable doubt" test was established. Remember it is REASONABLE doubt (what a reasonable person would believe under the same or similar circumstances) - the test is not beyond a shadow of doubt. The "gentleman" admitted he call them "fuc--ing" something.
