It's kinda hard to argue that you are mentally unfit to be held responsible for your actions when you drive yourself, engage in official business as a peer and manage your own finances. He did all three - after the CPS decided that his dementia was so bad that he wasn't fit to appear in court in April 2014.

Nothing stopping a prosecution in his absence, in any trial the accused can remain silent and leave the lawyers to speak for him

In many cases people are found guilty (or innocent) and they never appear in court at all

Whatever the reasoning, the initial assessment that the trial would fail seems to have been right.

You might be right but I rather suspect that he is likely to perk up a bit now that the threat of jail has receeded - it worked wonders for General Pinochet and Ronnie Biggs.
