the sentence appears dissproportionate to the punishment.

By that logic, driving whilst reading a book or watching a DVD should also be treated with no more than a slap of the wrist.

As car is half a ton of deadly fast moving metal and I for one think that someone in control of it should be activly "encouraged" by the courts to maintain their concentration.

I don't think so, what's the 'possible offence he didn't commit'?

 

The possible offence was that he wasn't texting at the time he happened upon a vehicle which was stationary, straddled across two lanes in a dark section of the motorway, having hit the central reservation because the driver was drunk.

 

The Judge said that the texting Ahmed HAD been doing, but had ceased doing several miles up the motorway, in no way contributed to the fatal accident.

 

I'm wondering what exactly has he been sent to jail for. It smacks (to me) of the Judge thinking that he should make an example of a sentence someone could expect if they WERE texting and became involved in an accident.

I've just been reading elsewhere that the drunk driver of the crashed car had abandoned it sideways, blocking lanes two and three on an unlit section of motorway, but had returned to it from the hard shoulder to retrieve his mobile phone when the car was hit by Ahmed. When Ahmed hit it, it had already been clipped by one car and narrowly avoided by another. The police accident investigators said that the car was not visible to other drivers until they were almost upon it.

 

For my money:

 

The guy who died was a Darwin award candidate. If he'd survived and Ahmed hadn't, he should have been prosecuted.

 

Ahmed was correctly charged with dangerous driving for texting and fairly convicted. I think it's unusually harsh for someone to get a custodial sentence for dangerous driving where nobody was hurt (the judge concluded that the texting happened earlier in the journey and was not the cause of the accident).

I'd give ANYONE caught texting whilst driving 10 years whether they had an accident or not. The accident is a red herring as far as I am concerned.

That's just the point - he wasn't convicted of killing someone by dangerous driving. It was determined that the activity that led to the dangerous driving charge (texting while driving) did not lead to the accident that killed someone. He had stopped texting some miles previously. He was caught texting because of the investigation into the accident, but the one did not cause the other.

This geeser pleaded guilty to the offence of dangerous driving so he got what he deserved, could have been even more if he had pleaded not guilty. No sympathy for him then. Next case. :)

new for 2014. where is the evidence that the south coast bream stock need the angling trust? Your campaign has no evidence. Why won't you work with your peers, the inshore under tens? As opposed to alienating them? Angling trust failed big time re bait digging, even fish legal attempted to intervene and failed, all for what, nothing.

Looks like the sea angling reps have been coerced by the ifca's to compose sea angling strategy's that the ifca's at some stage will look at drafting into legislation to manage the rsa, because they like wasting tax payers money. That's without asking the rsa btw. You know who you are..

How long before some idiot, also called Ahmed, reckons he only got sent down because the judge was racist and it was pure victimisation?

 

Sorry, but that seems to be the way this country is going of late.
