If it is true that he tried to mislead the court, surely that would leave the guy open to legal problems himself? That would be funny.

As is their right. Interesting to see what new evidence they can level against the skipper of the passenger carrying vessel. The cost out of public funds has already gone over 60k and the cfo has lost credibility, why can't he just do the right thing and go.

 

More importantly there is detail within the public domain regarding undersized bass being taken, loads, been reported to the authorities, however it's been ignored. So i'm going to look into that in detail and see if someone or an org are not doing their job with regards to what they are there for in the first place, stock protection as opposed to levelling pointless prossecutions that acheive directly the opposite.

The main points were that it was clear from the records of the SSFC that the bylaw was only ever intended to be applied to the CF as in ‘fish for sale’

Had that not been the case then the RSA charter boat ‘Torbay Belle’ would have qualified for grandfather rights when the bylaw was drawn up, but there was evidence that an application by the then owner was turned down as it was not deemed to be necessary.

 

The CFO was rebuked for gaining permission from the committee to not only lay charges against offenders but also to then decide on taking a prosecution to court. In any other situation it would be for an independent body like the CPS to make such decisions and had that been the case, this case would probably never have reach court.

 

The judge also referred to the CFO giving the court misleading evidence over his claim of not knowing the amount of Charter Boats that were/are operating in his district when there was evidence on his own web site that stated how many there were/are.

Blimey this man knows how to waste public money that’s for sure.

 

Ian Carrier should do the honourable thing and resign and let a new CFO get in and deal with the things this man has failed to address some of which were mentioned on WSF just yesterday.

 

It will be interesting to see what the new authority makes of things as they take over the reins on 1st April 2011and with a defence witness on that committee.

The introduction of new evidence is very rare, equally an appeal hearing is not a re-trail. The usual areas for consideration are errors of law, fact, or procedure.

 

I dare say any concerned ICFA rep can clarify if an appeal is to be launched by asking an urgent question to the relevant body, if there is a concern over further money being lost?

Thanks for the advice, i'm going to write to the new org and enquire as to why this course of action is the best way foreward in protecting the stock while spending more of tax payers money.

This argument, loads have had a dabble with this. At the time it even went to the minister and came back with the recommendation that it needs sorting locally. Now a judge has ruled and that isn't enough for the sfc, working on behalf of the local community. Something ain't right. It needs putting to bed.
