Buying a Car Advice

Need advice:-

 

My daughter went to a second hand car dealer, agreed terms and price, did not sign contract, decided to wait wanted time to think.

She returned the next day and decided to buy the car concerned, she saw the same salesmen, who had the contract in his top drawer, she signed payed the £250 deposit.

 

That evening she noticed the agreed prices on the contract were not the prices she had agreed verbally, an extra £900 has been added.

 

She went back confronted the salesmen, who denies changing the contract, and that the contract signed by her is binding, she should have fully read before signing.

When she asked to cancel the contract under her statutory right she is allowed 14 days cooling off period, they said they are not aware of any such thing, the contract is fully binding.

 

On reading the terms and conditions it does not mention anything about breaking the contract or refunds or canceling.

 

Question:-

Is she entitled to cancel the contract within a certain time frame?

Would she lose her deposit?

doesent it say in the contract? look for the very smallest print

Not sure of the legality, but get onto Citizens Advice and Trading Standards asap. A phone call from them will soon have him being a bit more civil about the whole affair.

Not a word, read whole T & C document.

 

 

 

 

Not sure of the legality, but get onto Citizens Advice and Trading Standards asap. A phone call from them will soon have him being a bit more civil about the whole affair.

 

She was supposed to have gone to those people today, will phone her now to find out if she did.

It seems that Car dealership manager contacted my daughter this afternoon, and tried to smooth things over by offering her a new contract on a different car. She refused.

 

She told the manager she would like her deposit back.

 

The manager told her to phone back tomorrow at 11am to discuss further.

 

Will keep you updated.

Whether or not she has any comeback in law, I'm sure a threat to take it to the local press and media is likely to pay dividends!

Exactly the same thing happened to a mate of mine a couple of years ago, CAB came up trumps for him in the end but it was a very stressful time for him and his family whilst waiting for it to sorted out.

 

Tell your daughter to see CAB asap before going back to the garage.

I must admit I thought cooling off periods only applied to cold calls (or what's referred to as Distance Selling in the rules and regs) and not if you approached the sellers, but I may well be wrong.

did the car have a full inspection(i.e 125 point blar blar)?

 

id go to the cab and also get the car tested for saftys sake!!

 

if its not road legal then it `should` make things harder for him...

 

also tell him that the internet is a big place with many potential customers and you wouldnt want to have to tell your mates how bad his business is!!

sod everyone else,do it anyway:)
