Hi Hastfish QUOTE/ having to dump anything from 10lb to 300lb per trip of cods from 1k up to 15k,and were still fishing for soles I take it that you mean bottom set nets left to fish on a long soak time ie overnight that is producing your cod discards, so much for these nets being selective and sustainable in the way they are fished I hear the Brighton fishermen are discarding as much as 15 x 25 kilo boxes of cod in there bottom set sole nets per day. Perhaps you should tends these bottom set nets and haul them every so often and release the cods alive thats responsable fishing you know, not go home to bed and then moan and groan about the amount of discards you have the next day and then blame Defra and the EU. I am trawling for sole and are getting alot of cod so we are hauling every half hour and are returning about 90% of our cod alive its hard work doing such short tows however I am trying to be responsable towards the future of the cod stocks, which seams to be wasted by how people work bottom set nets.   2. Defra may charge anglers a licence fee so they can buy back the under 10 metre licences, with lack of quota for that sector the licences are not worth much. Look on the bright side once anglers are licenced Defra will have to charge the GREENS so as they can buy out the angling licence for and on behalf of the GREENS TEHE welcome to the club HA HA HA it will not be long steve
  3. Commen sense, where is it? B.A.S.S, NFSA and any other angling REPS just keep bashing their heads against a brick wall. The BMP and/or The Marine Billl, looking to the future 2027, ect, ect, blah blah blah, if implemented wont make any difference whatsoever to fish stocks, the goverment and defra know this. Most fish stocks in UK waters (inside the 6 mile) are migratory and therefore spend as much time out of our waters as they do in it. Defra know this or should do. There is an enorous armada of other E U Member states permantlly fishing in the 6 to 12 mile zones around our shores, 24 hours a day, 7 days a week, 12 months of the year. Some not all of these vessels have GPS tracking fitted. These european fishermen fish our 6 to 12 mile zone because it is the best place to fish, all they are doing is GRINDING AWAY OUR FISH STOCKS Defra should know this To introduce the BMP into just Uk waters is complete lunacy any benifit there maybe will soon be HOOVERED up by the awaiting european shytalks and there aray of enorous trawls, as these fish stocks migrate offshore. Defra should know this Any one with any commen sense would or should know the Bmp should be done only at european level for it to have a half chance of succeeding Defra know this It is clear to me that most of the RSA REPS have no understanding of the commercial side of things. I challenge RSA REPS to what they should have done before submitting the BMP and that is ask Defra for a chart of all the other european member states fishing activities in the UK's 6 to 12 mile zone, then they may realise what I am saying has substance. DEFRA has this information the BlueFinger satellite tracking system (SAFFIRE) it monitors fishing activity in UK waters of all vessels over 15 metres and can track up to a 1000 vessels a day When the BMP was submitted to defra I cannot understand why defra did not discuss these points with the RSA reps or were whey lead up the garden path by defra???????? steve

DESCRIPTION OF THE PUBLIC RIGHT TO FISH The public right to fish was described by Moore and Moore as follows: In tidal waters, estuaries and arms of the sea below the high water mark of ordinary tides situate within the limit of the kingdom . . . the public as subjects of the realm, have the right to fish to the exclusion of the subjects of all foreign powers, except in such parts of those tidal waters as have been legally appropriated as private fisheries. Since the Moores' time, UK territorial waters have expanded from 3 to 12 miles from the coast and the UK has created an exclusive fishing zone extending to 200 miles. In neither case did the legislation set out clearly on what basis British and European fishermen would be operating in these additional waters but in the absence of any specific grant on the subject, it is likely that the public right extended to the 12 and 200 mile limits. It is also likely, after the Factortame case, that the public right has extended to EU citizens. In practice the public right to fish in law means that the entirety of territorial waters and the exclusive fishing zone have a primary use as a fishery using the most intensive methods possible, unless those rights have been specifically excluded. This is in contrast to the European Commission's targets for the Common Fisheries policy of responsible and sustainable fisheries practice. There is no mechanism in the public right to fish for seeding the sea or allowing it to lie fallow in the no take reserves proposed by the Royal Commission on Environmental Pollution. CONTEXT Property lawyers would recognise three rights granted by the Crown or UK Government departments to commercial fishermen. These are the public right to fish, some of whose users have a fishing vessel licence (of which there are a restricted number), some of whose users qualify for quota (for specific endangered stock). The structure of rights in fishing can be shown diagrammatically as follows: ------------------------------------ | | | Quota | | | ------------------------------------------------------ | | | Fishing Vessel Licence | | | ------------------------------------------------------------------------------------ | | | Right to Fish | | | ------------------------------|----------------------------------------------------- Sea angling and Commercial fishing with a commercial fishing vessel without a licence Quota and vessel licences have been used as tools to restrict fishing effort, either by restricting the number of vessels in the UK fleet or by restricting the catch of species in danger of decline. They also contain contractual restrictions and obligations. Fishing vessel licences only operate in respect of the vessel. It is the public right which permits a fisherman to catch fish. In England and Wales this public right has been managed traditionally by the creation of byelaws from Sea Fisheries Committees and Ministerial Orders from Defra (often implementing EU policy). These consist mainly of limitations on the public right, which are often highly technical and site specific. The result is that some fisheries, such as commercial fishing from boats, are embroiled in a complex web of bureaucracy, while others, such as recreational sea angling or commercial capture of fish without a boat, are barely regulated at all. QUOTE / And how are they going to take this law away? The marine bill wont take this law away it will supersede it in a far more positive way than byelaws,regulating and several orders. Under the marine bill it will be possible for defra to make a no take zone from the high tide mark going seaward and make it a angling no take zone, there is no need to licence anglers because they can be controlled using the marine bill and bag limitations. QUOTE / I don’t believe that you can put something through parliament and get cross party agreement to it and then just add or take away what ever you want under the disguise of the said naming of the bill. On the face of it the marine bill appears to be the holy grail of law that will readdress all the marine problems that may exist. According to the marine bill and its innovators the greens, our eco-systems and the bio and geo diverisities within our coastal waters will be completely sustainable and the envy of the world. Is it no wonder that there is cross party support for it??? What MP would dare to speak out against it???? I believe,allowing for the financial goverment involvment in the aggregate dredging industry and maybe wind farms, the voting power of the greens and the possible power the greens maybe able to exploit from the goverments compromised position in my opinion the marine bill will be a insidious act of law that will have far reaching affects on the publics right to fish wether that be angler or commercial fishermen. I have no faith in the motivation that drives the marine bill or the bodies that will implement it and overseer it I believe that it is not possible to achieve fairly and without bias steve
  7. Hi Barry Yes I did draft this myself, I sent Defra something similar and they got most indignant about it. I firmly believe the goverments position is compromised between their financial interest in the aggregate dredging industry and their introduction of the marine bill, you would think that the greens would take the goverment to task over the complete destruction of the eco-systemes by the aggregate dredging industry, but they dont. The goverment signed the 1992 Earth Summit aggrement with regard to the protection of bio and geo diversity, to date the goverment have not made any meaningful effort to mitigate the distructive efferts of the aggregate dredging industry. I wonder why, I can think of £100,000,000 per year worth of reasoning. I believe anglers and commercial fishermen should send the goverment a clear message of A VOTE OF NO CONFIDENTS in their ability to implement the marine bill fairly and without bias allowing for the goverments compromised position I also believe anglers and commercials will come out worst under the marine bill as it takes away the present law of the publics right to fish, the marine bill supercedes current law and Defra will be able to do whatever they like under the marine bill once it formally passes through Parliment Be prepared for the worst, the motivation behind it has already been predetermined regards steve
  8. Hi Challenge QUOTE / And who would you put in the place of DEFRA? Defra is a goverment department, the goverment has a very large financial interest in the aggregate dredging industry. The goverment/defra stand to gain more from introducing the marine bill than anyone else. For the marine bill to be laudable and completely free of bias its introduction and implementation and operation should be the responsabilty of a completly independant body not attached to any goverment department whatsoever or any other stakeholder. The existing farce regarding the marine bill is in my opinion the mechinism in which the goverment will expand their financial interest in the aggregate industry and it will be done in such a way that it will kept the greens happy (on side) by way of giving in to their every need and want. The winners will be the goverment and the greens the losers will be commercial fishermen and the anglers. In short the winners take it ALL and the losers have to FALL I believe the marine bill and its consultation has already got a predetermined outcome. Allowing for the goverments financial interest in the aggregate industry, and the potential vote pulling power of the greens, do you think the goverment are best placed to introduce the marine bill fairly and without bias to all stakeholders??????? Also do you think that the goverment will go against their financial interests by restricting the aggregate industries activities under the marine bill????? If the goverment were to spend the £100,000,000 per year revenue from the aggregate industry on improving the marine environment in conjuction with the marine bill then I would change my veiw as outlined above I believe the goverments integity is questionable and open to debate regarding this matter regards steve

Good and valid points on boths sides As I see it RSA reps put the BMP package to DEFRA, the package was to big and contained some mis-information RSA reps forced the commercials to defend the existing mls for bass because the only winner was the French, just like the Tope is now. The new Tope laws will doing nothing to protect or enhence the Tope fishhery as the French catch enormous amounts of Tope and will continue to do so. Not only did commercials defend the Bass mls but countered the RSA reps with licences and bag limits for all anglers We have now reached a position were commercials and anglers will fight each other tooth and nail every step of the way also anglers are spilt over certain things (a no win situation for all perhaps) What is clear to me is that when RSA reps try to get Defra to do something which is then opposed by the commercials Defra are then placed in a awkward position so they take the easy way out It must be pointed out that the GREENS have more power in and over Defra than anyone else and therefore the spilt between commercials and anglers is easy to exploit by the GREENS and Defra All or most of our fish spend alot of time outside our 6 mile limit and therefore all European fishermen can catch them RSA reps continue to make the mistake in trying to get Defra to discrimante against English fishermen by asking for new laws to apply inside the 6 mile limit which then benifits all other EU member states. Making new laws on migratory fish inside our 6 mile limit does NOT protect or enhence a fishery RSA reps need to realise that we in this country live in a European State and its laws, one of which is the CFP, If RSA reps were not so short sighted they would realise the situation that we now have between commercials and anglers has been brought about because RSA reps have approached Defra and not the EU Commission I would not have minded the mls increase for bass if it had been for all EU members states I only want a level playing field with my compeditors. If the spilt between anglers and commercials continues or worstens then we will all lose out as the GREENS Marine Bill progresses. Fighting amongst yourselves or with others NEVER COMES TO ANY GOOD steve

The powers to be have to implement the greens policies and in doing so have to make it appear that they have done it fairly Wether you like it or not the powers to be accept SACN as the voice of angling, there is no one else that could possiblly assist the implementation of the greens policies and in way that makes it look like it has been done fairly I believe The Marine Bill will consolidate and expand the govermments need for money, money, money from marine resources and to do that they need to sleep with the greens Us commercials and anglers are only hear to help draw up the very legistration that will undermine our future sport and livihoods its like knocking in the last nails into your own coffin LOL LOL steve

Hi All 20 miles of net One net bin is about 5 foot long x 2.5 feet wide and 2.5 feet high it may hold 200 fathoms of net, tops, no more than that 20,000 fathoms = 20miles therefore it would take aleast 100 net bins to take the 20 miles of net My boat which is a cat is 32 feet long x 16 foot wide and has a very large deck space, allowing for the wheelhouse and everything I would be lucky to get 20-25 net bins on my boat let alone a 100. 1 net bin full up with net would weight about 40 kilo x 100 = 4 tonne The anchors to moor up a 100 nets would weigh at least 1.5 tonnes The ropes from the anchors to the markers bouys and the markers bouys would weigh alot plus they would take up a large area of deck space They must be talking about very large vessels The price for bass will only go down if the quaility is poor steve

  23. Trawling in Lyme Bay has taken place for at least, many decades, the fact that fan corals are being washed up on the beach means that after all this time trawling has not wiped them out. Commen sense should say close the areas where they are and allow trawling in the remaining areas. The reasoning for closing the whole area beggars belief, the greens and defra make a uncomprimising awesome pair. WHEN BAG LIMITS FOR ANGLERS ARE INTRODUCED you will find yourselfs in this same uncomprimising position, having the greens, commercial fishermen and defra forcing the issue. you will then, when its to late realise whats happening to trawlermen in Lyme Bay can and will happen to anglers Fact is there is still alot of fan coral left in Lyme Bay, shame the Greens didnt put the same amount of effort into banning aggregate dredging that would be a laudable course of action however it would cost the Goverment aleast £100,000,000 a year and the greens would then lose their hold over the Goverment It appears that it is NO longer possible to live and let live, compromise is NO longer a meaningful word steve
