The Traffic Warden a money grabbing numpty.

I recently got a parking ticket for supposedly not parking correctly in a timed on street parking bay.

Now, I am disabled and there was only enough space at the timed bay for 2/3rds of my vehicle, the other 1/3rd was parked on double yellow lines without marked curbstones. Meaning three hours of parking without penalty.

 

My Disability badge and special access permit were clearly displayed so I challenged the ticket on the following basis.

 

2/3rds of my vehicle, under the rules of the blue disability badge scheme, could park in the timed bay indefinitely so long as my vehicle was insured, taxed and m.o.t 'd and the other third could park on double yellow lines for three hours.

I received the ticket after 1 hour and 38 minutes.

 

The local council wrote back to me to tell me my appeal was successful and I thought that I would share some of the reply because it really did make me chuckle.

However, I must warn you that any further penalty charge notices issued for similar contraventions may not be cancelled.

 

Please be aware ‘Not parked correctly within the markings of the bay or space’ is an enforceable contravention even though your vehicle is entitled to be parked in either restriction.

In their own words I am allowed to park either side but could get a ticket for parking either side, a case of the right hand not knowing what the left is doing.

I think you will get that squashed and rightly so. You obviously got a Mr Jobsworth but very harsh to do it to a disabled especially .

Why should the disabled flout the rules ? If its between areas its the same as anyone else doing it ,just park on the yellow lines

 

I wish i was as fit as some disabled drivers ,one stopped on yellows ,displayed a badge and RAN to the supermarket and came out puffing a fag ,got back in and drove off ,perhaps not disabled himself but illegally using a badge ,i wish there had been a warden about to tip off !

It reads like chester suggests if you either park entirely in the parking bay your fine, if you park entirely on double yellows your fine (for alimited time) where you fall foul is parking across two different zones or as it says in the correspondance " Not parked correctly within the markings of the bay or space’ is an enforceable contravention even though your vehicle is entitled to be parked in either restriction".

 

As for picking on the disabled well thats equality for you it covers the bad as well as the good.

I thought that I was using my initiative by using as much of the timed bay as possible thus leaving sufficient double yellows behind me for another disabled driver to park. Yes, I could have parked fully on the double yellows but the space in the timed bay would have been wasted and there would not have been enough for anyone else to use as they could not have maneuvered sufficiently to fill it. Speaking to two other traffic wardens, who viewed the photographs I took, they stated that their colleague had definately been over zealous in his duties for they would not ticket unless a vehicle was over halfway out of the timed zone. Even they told me to appeal and that my appeal would be upheld. If I can park either side why should I not use common sense and park as fully into the timed zone as possible thus allowing other disabled drivers the space behind me to park?

To me this is another means of trying to get as much revenue as possible for local authorities.

 

@ Chesters...what rule did I flout? I can legally park either side...they said so in their reply.

 

@ Snakey... If I can legally park in either zone how can I fall foul?

 

As to picking on the disabled, I would love to see more equality, I never suggested that they were picking on the disabled in any part of my post; or did I miss something?

You didnt break any rules you bent the wardens interpretation of them so he wasted time issuing a ticket in the time he could have issued one to a real offender round the corner

It also wasted the time of whoever decides if the ticket was issued correctly and the councils time demanding their pound of flesh ,time has consequences of using more time

I am a bastard but i am not capable of stooping so low as to be in politics ,infact i think stooping that low is physically impossible except if your already bent
