are you breaking the law in boats?

as this effects both fresh water and sea i posted it here.

i read today (the sun so probably incorrect) that the no smoking laws apply to boats as well as other work places if they are a workplace (i.e you pay a skipper) .

just how there going to enforce it in the 12 mile limit i havent a clue but its the law .

your ok though if you smoke in your cabin ,mind you do you have a cabin on a inflatable or even a fishing boat at sea ,there is a cabin in the latter but its the skippers?.

if you smoke you could get round it i suppose if he doesent serve food so take your own bait

As i understand the no smoking law,

 

No smoking is allowed in any enclosed public space, including places like pub gardens.

 

smoking while walking down local high street is ok, but smoking while standing outside your work place is not.

 

I should imagine the same rule would apply to boats as it would to company car drivers.

No smoking in company cars, unless you have a convertable, then your are allowed to smoke, only if you have the roof down.

This also applies to tractor drivers in a field miles away from any road.

 

Unless you are in scotland, then smoking in a company car is ok, but not in a van.

 

 

The police only have to smell tobacco to be able prosecute.

 

So technically if you are in a company car, speeding, 1 slightly bald tyre, holding a mobile phone in your hand, get stopped, police smell burnt tobacco in the car which you had an hour ago in the services car park, you can get band from driving. = 12 points.

hmmmmm as the inside of a car could be a "cabin" and its enclosed you should be ok ,if the lorry belongs to you surely the same rules apply ?

very confusing

it must be the "work" factor ,a lorry is a work place as is a salesmans car ,but if they are between locations (the lorry empty and the salesman in transit to a client) your not working but going to work?

if you smoke on a public street even outside your work your still in a public street (perhaps if you walk 2 steps back and forth you then get around it)

ofcourse the bars in parliament are exempt from these rules proving the "do as i say not do as i do" is alive and well :rolleyes:

This an interesting one! My missus suffers from progressive MS and has been told by the MS specialist to continue smoking as it is to relieve pain.

I want to get this in writing, as it would appear that if she takes medical advice she is breaking the law!!!!

Chesters, I dont allow smoking on my wee "private" boat, I decided that after I saw my mate sitting on top of 25 litres of unleaded, smoking away , not a care in the wolrd....!!!!!! :blink: :blink:

 

I have No Smoking signs up now !!!! :)

I've contrived to inhale a variety of substances over the years but never came across one that I thought offered actual pain relief.

 

Are we talking about the sort of baccy I think we are, or is there something I've missed?

mind you a pipe could be deamed a heater?

and ofcourse theres golf courses and fisheries ,privately owned and a work place!

army ranges ,the new forest and any NT properties (estates) are work places ! looks like the only place smokers are welcome is in the bars in parliament ,strange that!
