If I sued for everytime I have had a slip trip or fall while fishing i would be a very rich man. I find it a bit sad that some fool falls over and thinks he can blame a fishery owner for it. How many people on here are not aware that a wooden platform can be slippery when wet? I would hope that everyone was aware of this fact. Particularly after having lived for over 50 years and very likely been in contact with wood in that time.

 

This guy very likely knew exactly what he was doing and sadly the owner bore the brunt of it.

 

Just another reason why I cant stand the way law works in this soft country of ours. :wallbash:

+1 i agree with you, i am 24 and i think personally i act older and take responsabilty better then a certain 50+ man.... hes over twice my age... says somthing really...

Steve i have just realised that the cup of Coffee you kindly gave me out of your flask has burnt my tongue so i am gonna have to sue you i am afraid and Rusty when you let me use your new Pin today i appear to have got repetive strain injury from winding in so see you in court guys ;):D .

No you are all right Steve i have just insured it for 3 million cover so claim away as long as its not over 3 mill ;) ,has gone a bit crazy though this no win no fee mallarkey eh??

We are not putting it back it is a lump now put that curry down and go and get the scales

We can have a Anglers Net Claim In! at the next LIF Fish In! Line all the cars up with the guys stood at the back of them all sorting their gear out,me at the top of the track in the pimp mobile.JV comes flying down trying to beat me to pole position,brakes to hard,Portabote comes of roof,smashes into me in the pimp mobile (which just happens to still be in low ratio) I'm knocked out and the Best Four by four by far lurches forward inexorably towards the lined up cars,members and their top of the range tackle (a collection of Chesters old Intrepids and Dave's Bean pole rods!).........I get a new rear end for my motor plus whiplash,and a hundred and one mental problems caused by post traumatic stress! you all get a fortune for stress and to replace the "Normark" rods and "Witcher" reels that were destroyed! and of course JV can then afford to buy a proper boat! Simples!

well at least most of you agree with me, the whole experiance of fishing is to be out doors in the wild, i don't want to see horrible stuff like not being funny to you lutra but no.... just no.. a platform at work vs a platform for fishing that has griped material on top, if yu don't like them i am sure you can make your own and maybe take it fishing with you...

 

but on topic, i have fallen over at lakes i have fallen in lakes cut myself hit my self on the head with a wieght (kids falt!) lol blame he kids hahaah.

but i never sued anone for it.. i mean is it the lakes falt if i get a barbed/less hook in my body... do i sue them?....

this is a shame, just remember folks fishing is for the wildlife viewing, enjoyment and peace... jut hope nobody on this site sues because they are clumsy. B)

I think your getting a little off topic on your own topic Dean. Your link is about someone suing after they claim to have injured (and you don't hear his side of the story, like the judge did) themselves on a man made platform (which belonged to the fishery not him), on a commercial fishery. This is not about someone on a natural "wild" water slipping in the mud, on grass or stubbing his toe on a piece of untamed mother earth.

blooming cheek......but veeery interesting though ;)

trouble is new for old isnt any use to me and unique reels are value determined by collectors not insurance companies :D

if i have a unique reel its worth more than all the normarks and witchers which are massed produced in comparison ...to me others may differ so in some cases is insurance worth the bother? my house contents are not ensured! 11 years ago we had nothing, we lived!

now i'm clever though we have alternative housing heating and lighting in the garden and sheds ,we wont be caught out again but the reels would be expendable its just stuff ,some irreplacable but just stuff

 

this compensation "culture" isn't fed by claimants their "cut" is tiny compared to the companies that exploit it ,if owners who fail in their stance of protecting the masses (yes theres laws out there "duty of care") simply held up their hands compensated the injured and made sure the problem didnt occur again then the "culture" wouldnt exist.

 

ofcourse from the other side the duty of care also impinges on the injured ,putting yourself in danger should count against any compensation claims you make.

 

but **** happens so do accidents signs or not ,this bit is usually glossed over by the companies out for costs
