i think your not allowed to torture them for several hours before ringing the fuzz  mind you youl probaly have several hours after ringing them ,just say he kept trying to evade the arms of the law and multi restraining blows had to be used

Believe NOTHING anyones says or writes unless you witness it yourself and even then your eyes can deceive you

None of this "the enemy of my enemy is my friend" crap it just means i have at least two enemies!

There is only one opinion i listen to ,its mine and its ALWAYS right even when its wrong

SandTiger:

Alan, the key word is grossly disproportionate and also a refferal to the DPP before charge?

This still means it isn't clear as to what is allowed and what is not, and relies on the judgment of the director of public prosecutions' opinion as to whether or not you stand trial.

The point I am making is that had the law been specific there would have been no debate about if's and maybe's.

This is a signature, there are many signatures like it but this one is mine

One does not have carte-blanche to murder an intruder, nor to extract revenge or retribution! Why is this such a difficult concept for some to get their heads around?

The problem isn't what people don't know, it's what they know that just ain't so.

I always find that it's best to ask them to step out onto the lawn before killing them. It makes a hell of a mess indoors and that Cillit Bang cleaner can ruin any ornamental granite surfaces.

Not sure if the UK rules are that similar to ours but note the use of 'unlawful' to describe a killing that would class as murder.

Definitions of murder on the Web:

unlawful premeditated killing of a human being by a human being

www.cogsci.princeton.edu/cgi-bin/webwn

The unlawful killing of a human being by another with malice aforethought, either expressed or implied. (see Homicide; compare Manslaughter)

The unlawful killing of a human being by another with malice aforethought, either expressed or implied.

www.indygov.org/courts/glossary.htm

The unlawful killing of a human being with deliberate intent to kill. Murder in the first degree is characterized by premeditation; murder in the second degree is characterized by a sudden and instantaneous intent to kill or to cause injury without caring whether the injury kills or not. (See also manslaughter.)

Why is this subject given such a high profile when its not an issue in real life? IMO the law as it stands is bloody sensible.

Nobody i know of, even through "friend of friends" kind of connections, has ever been charged with defending themselves against a housebreaker.

I can think of a few local evil b*stards and night club minders that could twist any change in the law to suit themselves though. "Sorry officer found him at my back window and you know how it is..."
